Patents Legislation Overview

The legislation governing the functions of the Intellectual Property Office of Ireland consists of primary legislation, Acts and secondary legislation, Rules and Regulations.  The Rules and Regulations prescribe the manner in which the relevant provisions of the Acts are to be implemented.

SPCs are granted in Ireland in accordance with S.I. No. 307/2008 - European Communities (Supplementary Protection Certificate) Regulations 2008.  These regulations give effect to Council Regulation (EEC) No. 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products, as amended by Regulation (EC) No. 1901/2006 of the European Parliament and of the Council of 12 December 2006 on medicinal products for pediatric use, and Regulation (EC) No. 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products, in Irish law.

IP legislation from other countries

The World Intellectual Property Organisation (WIPO) maintains a database called WIPOLEX which is a one-stop search facility available to the public for national laws and treaties on intellectual property (IP) of WIPO, WTO and UN Members.  It also features related information which elaborates, analyses and interprets these laws and treaties.  It provides streamlined access to reference material of key importance for optimal information on the global IP System.
